What the state page said
The New York State Department of Agriculture and Markets home-processing page, opened October 7, 2026, describes a Home Processor Exemption from Article 20-C for listed non-potentially-hazardous foods. Registration with the department is required. The page says there is currently no fee. The registration is location-specific, and sales are within New York State only.
Food must be pre-packaged and labeled in the home. The page’s label items include the common name, ingredients, net quantity, the processor’s name and full address, allergens, and a “Made in a Home Kitchen” phrase. A FAQ on the same page says internet sales are allowed within New York State only, and that shipping out of state is not permitted.
Not every food qualifies. The page’s prohibited examples include dairy buttercream, vegetable breads, alcohol, pickles, sauces, meat, fish, poultry, beverages, raw nuts, and refrigerated products. Reviews are described as complaint-based. The page does not state a sales cap. Zoning is yours to check. Sales tax is a question for the Department of Taxation and Finance. The department address on the page is 10B Airline Drive, Albany, NY 12235.
